Terms of Service

These Terms govern your use of Rubrica, operated by Quickers Italia. Rubrica has two products: Rubrica Professor (an AI teaching copilot for educators and institutions) and Rubrica Student (a personal study-notes assistant for individual learners). Both are engineered for European digital sovereignty: they run on European infrastructure and European AI, and process your data inside the EU. By creating an account or using Rubrica you agree to these Terms.

1. The service

Rubrica helps educators build courses, quizzes and lecture decks, run classes, collect peer and jury ratings, and generate objective 360 reports - assisted by artificial intelligence. Features and plans may evolve over time.

2. Accounts & eligibility

You must provide accurate information and keep your credentials secure, and you are responsible for activity under your account. Rubrica Professor accounts are intended for teachers, instructors and their institutions. Rubrica Studentaccounts are personal accounts for individual learners; if you are under the age of digital consent in your country, you need a parent or guardian's permission.

3. Data protection roles (GDPR)

  • For your account and institutional data, Quickers Italia acts as data controller.
  • For student personal data you process through Rubrica (rosters, emails, attempts, ratings, feedback), your institution is the controller and Quickers Italia acts as processor on your documented instructions.
  • A Data Processing Agreement (DPA) is available on request and, where signed, governs that processing. Contact hola@rubrica.pro.

4. European sovereign infrastructure & sub-processors

Rubrica is built to keep your data and the AI that processes it inside the EU. Our sub-processors:

  • Mistral AI (Paris, France) - AI generation via its paid API. Per Mistral, inputs and outputs to the paid API are not used to train its models, processing is EU-prioritised, and API data is retained only briefly for abuse monitoring (or zero-retention where enabled).
  • Hostinger - European hosting for our self-managed servers. No US hyperscaler (no AWS/GCP/Azure), no Vercel.
  • Our database, authentication and file storage (self-managed, open-source, on our own EU servers) and text-embedding models (local Ollama) run on our own EU servers and are not third-party services.

We maintain an up-to-date list of sub-processors in our Privacy Policy and will give notice of material changes.

5. AI-generated content & human oversight

  • AI outputs (quizzes, slides, reports, answers) may be inaccurate or incomplete. You must review and validate them before use - the educator remains responsible for all teaching and assessment decisions.
  • Consistent with the EU AI Act, Rubrica supports transparency and human oversight and does not make high-risk automated decisions about students. Grading and evaluation decisions remain with the teacher.

6. Acceptable use

You agree not to:

  • use Rubrica unlawfully or to infringe others' rights;
  • upload content you have no right to use, or that is unlawful or harmful;
  • attempt to re-identify individuals from aggregated or anonymised data (e.g. peer ratings);
  • probe, scrape, overload, or reverse-engineer the service, or bypass its security.

7. Intellectual property

  • You retain ownership of the content you upload and, as between you and us, of the materials Rubrica generates for you (decks, quizzes, reports). You grant us the limited licence needed to host and process them to provide the service.
  • We retain all rights in the Rubrica platform, software and brand.

8. Availability & changes

We aim for high availability but the service is provided "as is" and may change. We may update these Terms; material changes will be notified and continued use constitutes acceptance.

9. Limitation of liability

To the maximum extent permitted by law, Quickers Italia is not liable for indirect or consequential damages, or for decisions taken in reliance on AI outputs without human review. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Termination & data portability

You may stop using Rubrica at any time. On termination you can export your data, and we delete or return personal data in line with the DPA and our Privacy Policy.

11. Governing law

These Terms are governed by the laws of Spain and applicable EU law, without prejudice to mandatory consumer or data-protection rights. Courts of the operator's registered seat have jurisdiction, subject to those rights.

12. Rubrica Student - subscriptions, consumer rights & your content

  • You keep ownership of everything you upload and of the study notes Rubrica generates for you. You grant us the limited licence needed to host and process them to provide the service.
  • Free plan. The free plan is offered in exchange for allowing your uploaded content and generated notes to be used, in anonymised/pseudonymised form, to improve Rubrica. You can move to Pro at any time to disable this.
  • Pro plan. €5/month or €50/year (incl. applicable VAT). Your content is private and never used to train or improve our models. Subscriptions auto-renew until cancelled; you can cancel anytime from your account and keep access until the end of the paid period.
  • Right of withdrawal (EU). As a consumer you normally have 14 days to withdraw. By starting to generate notes immediately you request that the service begins during this period and acknowledge you lose the right of withdrawal once it has been fully performed. Statutory rights are unaffected.
  • Integrity. Rubrica Student is for learning. You agree not to use it to complete graded or assessed work dishonestly, or in breach of your institution's academic-integrity rules.
  • Payments are processed by Stripe; billing details are handled by Stripe and are not stored by us.
